Will Lindsay Lohan be charged with lying to the cops regarding her Porsche-vs.- big rig crash on Pacific Coast Highway? Only time — and the Santa Monica city prosecutor — will tell.

A Santa Monica police investigation has determined that Lohan was driving the car at the time of the June crash, which contradicts what she told police after the accident, The Times’ L.A. Now reports.

While Lohan reportedly told authorities she wasn’t behind the wheel, her assistant told police he was the one riding shotgun, while the big rig driver said he saw the actress in the driver’s seat, according to TMZ.

The Los Angeles County district attorney apparently decided the mismatching stories didn’t merit a felony case, so passed the package off to the Santa Monica prosecutor’s office to decide if any laws were broken, prosecutors told L.A. Now.

That Lindsay must “obey all laws” is a condition of her now-informal probation, part of a deal she struck after pleading no contest to theft of a necklace in May 2011. If her probation were violated, she could be looking at jail time.
