Lindsay Lohan won’t face charges in alleged N.Y. night club assault
Facing a court-ordered stint in a locked-down rehabilitation center for reckless driving and lying to police in Santa Monica, Lindsay Lohan won’t be charged in an incident at a New York nightclub.
Psychic Tiffany Mitchell alleged Nov. 29 that Lohan hit her at a Manhattan club. Lohan through her attorney has denied striking the woman.
At Lohan’s sentencing this week in Los Angeles on two misdemeanor charges related to a traffic collision on Pacific Coast Highway, a judge indicated that if Lohan were charged and convicted in the New York case, it could be considered a violation of her probation.

Gloria Allred, Mitchell’s attorney, said her client “is very disappointed” that the district attorney has not decided to prosecute Lohan in connection with the incident.
She added, “Tiffany had two witnesses who spoke to the district attorney and corroborated what Tiffany alleged to have occurred.”
Allred said the district attorney never indicated that there were any issues with Mitchell’s credibility.
“Nevertheless, it appears that the district attorney’s office feels that the case against Ms. Lohan cannot be proven beyond a reasonable doubt, which is the high burden of proof required for conviction in a criminal case,” Allred said.
Allred said Mitchell is considering a civil lawsuit “because of what she suffered that night.”
In addition to ordering Lohan to spend 90 days in rehab, L.A. County Superior Court Judge James Dabney said she must complete 18 months in psychotherapy and serve 30 days of community service.
In pleading no contest, Lohan admitted she had violated her probation in a 2011 shoplifting case. Dabney sentenced her to 180 days in jail, but that sentence was stayed. The judge said that if Lohan met the terms of this deal, she wouldn’t serve additional time behind bars.
But the judge warned there wouldn’t be any discussion about probation if she violated the agreement, implying that she would be sent to jail.
