49ers’ Aldon Smith won’t face criminal charges in alleged LAX threat

San Francisco 49ers linebacker Aldon Smith won’t face criminal charges for his April arrest at Los Angeles International Airport, where police alleged he made comments suggesting he had a bomb.

The Los Angeles city attorney’s office announced Tuesday it had reviewed the matter and would not file criminal charges in connection with the case. In April, the county district attorney’s office declined to file felony charges and referred the case to city prosecutors for misdemeanor consideration.

Instead, those involved in the incident are scheduled to attend a July 30 hearing at the city attorney’s office, where they will be “admonished about the applicable laws and given suggestions on how to avoid similar incidents in the future,” spokesman Frank Mateljan wrote in an email

“While the City Attorney reserves the right to file charges up to one year following the incident, no further action is scheduled beyond the office hearing date,” Mateljan wrote.

Smith, 24, was arrested April 13 by LAX police after he allegedly became argumentative with a Transportation Security Administration agent. He had been randomly chosen for a secondary screening and “became belligerent and uncooperative with the process,” airport police Sgt. Karla Ortiz told The Times after his arrest.

Smith then made a comment to the agent “indicating he was in possession of a bomb before proceeding toward the gate area,” Ortiz said.

Airport police caught up with Smith at the gate, where he became uncooperative and was then detained, Ortiz said. He was later booked at the Los Angeles Police Department’s Pacific Division on suspicion of making a false report of a bomb threat.

Smith’s legal troubles, however, extend to the Bay Area.

He is awaiting sentencing for two unrelated cases out of Santa Clara County: two misdemeanor DUI counts and three felony counts of possessing illegal assault rifles. Last month, Smith pleaded no contest in both cases.

The DUI charges stem from a September arrest in San Jose, where authorities said Smith’s blood-alcohol limit was twice the legal limit. A month later, prosecutors filed the weapons charges, saying authorities found three assault rifles while responding to a complaint about a party in June 2012 at Smith’s home.

Smith is scheduled to be sentenced July 25, a day after the 49ers hold their first training camp practice.
