  • MISCONDUCT ?? NO. Stupidity? YES! I don't think I'd want a stupid judge deciding my appeal (no, I don't have one), but I think Ms Bazelon is exagerating. I didn't see the website, but last I heard in USA you still have "Freedom of Speech". presumably the Judge was awre of that. Stupid, YES! impeachment ?? nah

  • oh give me a break. a jurist has material that some say is pornographic. on a private web site. others say it is funny and a parody. this judge has, for years, been a champion of the First Amendment rights of our citizens, and these photos are just that... the artists' freedom to express , however distasteful it might be to some, in a way that is critical of certain aspects of our society. i for one would give him the benefit of the doubt. he's more than earned it.

  • The descriptions of the images and videos are inaccurate, and the site was private. Sanai has admitted the accusations against Kozinski were part of a "litigation strategy" and he is, by all accounts, an attorney who relies more on such "stratgies" than on the merits of the case. Enough of this smear campaign already.

  • I agree with comments of Richard W. Has Judge Kozinski done anything illegal? It may be deemed in poor taste, or even immoral that he enjoys pornography, but unless the photos involve something illegal, I'm not sure (and this essay certainly doesn't make clear) why Kozinski is in an impeachable position. Also, I'm disappointed that the web address for Kozinski's site isn't posted here - I'd like to judge for myself (and so, I suspect, would some of the other "morally outraged" readers).

  • Why is Lara Bazelon repeating the same lies and inaccuracies about the contents of Judge Kozinski's server? The fact that the LA Times purposefully lied about the contents of the server has been exposed on any number of respectable news sources, why does the Times insist on sticking to these lies?

  • Comparing Kozinski with Real is too much. Inflammatory descriptions of his images are inaccurate. Plus, the site was private. The videos are on YouTube to judge. Accusations that he posted bestiality are disturbing. It’s a nitwit trying to poop who finds himself running desperately, pants down, from an aroused burro. Kozinski says he posted it because IT WAS FUNNY. Judicial misconduct? We are still puritans. The avoidance of impropriety is achieved; no public hanging should be demanded. I’m a woman old enough that I was alive when Stewart said about obscenity: " but I know it when I see it . . .” The material in question doesn’t make the cut.

  • I would respectfully disagree with the premise of your opinion piece, that is "that Kozinski maintained a private website replete with pornographic material...". Let me cite just one example. The so-called "bestiality" themed video is from You Tube, showing a laughing fat guy who is chased in circles by a rogue donkey with an erection. The Kozinski so called "stash" is all ribald humor of the kind that is emailed around all the time, and was correctly described by the DC blog Wonkette as "the sort of naughtiness you’d find in the dirty birthday cards section at Spencer Gifts."

  • Except for a few things. First, the “outraged responses” were responses to a mere newspaper report giving vague summaries, rather than any firsthand access to the material, a newspaper report which has since been shown to have been of limited accuracy - certainly limited clarity - and thus of causing people to completely misunderstand the nature of the site. This statute would appear to be based on public perception. What if public perception is false? How is Kozinski then to blame for it?....   • Apart from appearance of impropriety or conduct prejudicial to the administration of justice, isn't there a potential here for criminal prosecution? Judicial immunity and lifetime tenure have no application to that.
