Common decency requires that those who have spent considerable time in prison because convicted of a crime they did not commit should be compensated without having to sue. The compensation should be sufficient to ensure that they are in a position to get whatever help they need to resume life on the outside plus a generous sum to redress the wrongful deprivation of their liberty. A person who has been wrongly put away for five years should receive at least $1 million. Immediate family members--spouse and children--ought also to be compensated for their suffering.

If the court finds them innocent then the state must follow suit and allow them to live as freely as any other citizen. Because of the horrible state deficit I doubt a new found innocent wo/man would ever get monetary compensation. But at least they'd be free to sue.
