Re “Bad initiatives make bad law,” Opinion, April 27

Whether you agree or disagree with the premise of Proposition 8, the 2008 California same-sex marriage ban, is irrelevant.

We elect public officials to enforce the will of the people. The attorney general’s decision not to defend Proposition 8 in court was in direct conflict with that will.

The attorney general should have vigorously defended the initiative, regardless of her personal beliefs, and settled the case on its merits. Instead, we got a non-decision based on standing.

This is what necessitates the additional verbiage in the new propositions allowing initiative proponents to defend the law. Had the attorney general done her job, this would not be necessary.
