Attorneys representing Metro Police Officer David Bisard have petitioned the Indiana Supreme Court to overturn a Court of Appeals ruling in the drunk driving case against him.
Bisard's attorneys claim, retired Chief Justice Randall Shepherd overstepped his bounds when he overruled the Superior Court judge’s findings.
The lower court judge ruled Bisard’s blood sample could not be used in the case against him because it was improperly drawn at a clinic. Shepherd ruled that the blood draw was properly taken.
Bisard’s attorneys want the original judge’s ruling reinstated.
In August 2010, Bisard ran into three motorcyclists, killing one, while on duty.
