Charges against a woman accused in a stabbing were withdrawn at a preliminary hearing Tuesday because the victim refused to testify.
State police charged Ashley Kamilah Arnold, 20, District Heights, Md., with aggravated assault. She was accused of stabbing Justin John Seeley, 21, Cannery Road, Somerset Township, on Jan. 20. He suffered three stab wounds to the right shoulder and side of the head with a kitchen knife.
District Attorney Lisa Lazzari-Strasiser said she had information that Seeley was not going to appear at the hearing, but she was uncomfortable about withdrawing the charges without his attending a hearing. The hearing was postponed several times. Seeley did attend the hearing on Tuesday before District Judge Ken Johnson of Somerset and refused to testify.
“Since he refused to testify, the charges were withdrawn with prejudice, meaning they can’t be re-filed,” Lazzari-Strasiser said.
