Marion County criminal court Judge Grant Hawkins says he is still deciding if the Officer David Bisard trial should be moved to another county.
Judge Hawkins made the comments during a pre-trial hearing Friday for the IMPD officer who allegedly drove his department issued car into a group of motorcycle riders August 6th while impaired.
One man died and two others suffered serious injury.
Also during the hearing, Marion County Prosecutor Carl Brizzi confirmed his office will still try to use the blood sample taken from the officer after the crash. In August, Brizzi announced the blood alcohol test result of .19 would not be admissible as evidence and he dropped the most serious drunk driving charges.
Brizzi says he's confident he can get the blood alcohol test back in as evidence. He told the defense, no matter what, he would attempt to bring the blood draw back in as evidence.
