State Sen. Marian Bergeson (R-Newport Beach) postponed consideration of her bill to restore to cities and counties immunity from liability for certain injuries incurred at beaches and other recreational areas. The Senate Judiciary Committee hearing was reset for May 7 to give Bergeson time to deal with some objections to the measure. A 1982 court decision narrowed or eliminated statutory immunity concerning injuries resulting from the elements. An Orange County Superior Court jury later awarded a $6-million judgment against Newport Beach, and other suits are pending in the state.
