MGM/UA Suit Against Disney to Go to Trial: MGM/UA Communications said Thursday that the 2nd District Court of Appeal in Los Angeles ordered that a suit filed by MGM/UA against Walt Disney Co. be sent back to Superior Court for trial. The order reverses a Superior Court decision dismissing MGM/UA’s suit charging fraud, unfair competition and breach of contract over Disney’s right to use the MGM name on a movie studio in Florida. MGM/UA filed the suit in 1988, charging that Disney had violated its licensing agreement by using the MGM name on a full-scale motion picture studio rather than on an amusement park with a motion picture theme. A spokesman for Disney said the company is prepared to go to trial in the case. (Filed May 17, 1988. Case No. C686329)
