Burbank man not charged in death

The Orange County District Attorney’s office decided not to file charges against two Burbank brothers who were involved in a fatal bar fight in Newport Beach in April.

Tustin resident Jason Boozer, 26, died after he was pushed or punched and hit his head on concrete in a fight outside Muldoon’s Dublin Pub on April 29.

Marc and Brian Weiner, of Burbank, were arrested in connection with Boozer’s death.

But Dept. District Attorney Matt Murphy said there is not enough evidence to file against the brothers.

“This case was thoroughly investigated by the Newport Police Department and at this time there is not enough evidence to proceed against either brother for any crime,” Murphy said.

The brothers were at the bar in the 200 block of Newport Center Drive when the fight began over a woman one of the brothers was talking to. Boozer allegedly went after one of the brothers and the other brother allegedly stepped in between them. It’s unclear whether Boozer was punched or shoved, according to the Orange County District Attorney’s office.

Boozer fell backward and hit his head. He was taken to Hoag Memorial Hospital Presbyterian in Newport Beach, where he died.
