Driver accused in road rage killing of Aiden Leos out on $100,000 bail

The driver accused of being an accessory to the alleged May road rage killing on the 55 freeway is now out on bail, officials at the Orange County district attorney’s office confirmed on Monday.

Jail records indicate that Wynne Lee, 23, was released on Saturday on a bail of $100,000. Lee was previously held on a bail of $500,000 until a hearing on Friday lowered the amount to $100,000. Court officials said that Lee would need to surrender her passport and would be subject to GPS monitoring and barred from having contact with co-defendant Marcus Anthony Eriz, 24.

Eriz remains in custody as his bail was revoked last Friday.

The two were charged in the shooting that killed 6-year-old Aiden Leos. Lee is charged with being an accessory to the crime after the fact and of having a concealed firearm in the vehicle. She pleaded not guilty with Eriz to all charges on June 18.

Prosecutors say that on the day of the shooting, the couple was heading to work in the HOV lane of the 55 Freeway at about 8 a.m. May 21 when they approached a Chevrolet Sonic, driven by Joanna Cloonan, who was taking Aiden, her son, to kindergarten.

Lee then maneuvered her Volkswagen Golf SportWagen into the left lane and cut Cloonan off. After a few miles, Cloonan then exited the lane but raised her middle finger to the two. Shortly afterward, she heard a loud bang behind the rear of her vehicle and her son say, “Ow.” The couple proceeded to work and Cloonan pulled over, prosecutors said.

Aiden was taken to the Children’s Hospital of Orange County, where he was declared dead at 8:39 a.m.

Lee’s attorney initially requested that Orange County Superior Court Judge Larry Yellin lower Lee’s bail to $50,000 to be on par with what she is charged with, a request that was rebuffed by Yellin as being too low because she continued to allow Eriz to ride with her as a passenger.

Court documents indicated that the two were involved in another incident in the week after Aiden’s death, in which Eriz allegedly brandished his gun at the driver of a blue Tesla on the eastbound 91 Freeway.

Eriz and Lee are scheduled to appear in court at the Central Justice Center in Santa Ana on Aug. 27 for a pretrial hearing.
