The Orange County district attorney’s office has declined to file charges against a man who allegedly displayed symptoms of alcohol consumption after his car overturned in Huntington Beach, injuring several passengers.

Huntington Beach Police Lt. Mitch O’Brien said Midway City resident Fidel Barrera, 22, has been released from custody. But he could be charged later based on the pending results of the toxicology report.

Police responded to the accident at 4:23 p.m. June 25 at Warner Avenue and Algonquin Street and found that the green 1999 Toyota 4-Runner had overturned several times, sustaining severe damage. Aside from Barrera, the driver, there were four other passengers in the car, O’Brien said.

One passenger was trapped under the vehicle and was extricated by city firefighters. She remains in critical condition, O’Brien said. The rest were released from the hospital.

Barrera was also transported to a local hospital and after being released was booked into the city jail on suspicion of driving under the influence. He was also driving on a suspended license.

The details of the accident are still under investigation. Anyone who might have witnessed the accident is asked to contact Officer Dennis Fulton at (714) 536-5670.
