Hearing set for Spears, Federline

Britney Spears and former husband Kevin Federline were ordered Wednesday to appear in court later this month by a Los Angeles County Superior Court commissioner who is seeking to resolve the custody battle over their two toddler sons.

In a proceeding lasting more than three hours, Spears, 25, and Federline, 29, were ordered to attend a hearing Oct. 26 before Court Commissioner Scott M. Gordon, part of the continuing fight over custody of Preston, 2, and Jayden James, 1.

Federline, dressed in a blue-gray pinstriped suit and sporting designer eyeglasses that partially hid a patch over his right eye, made a surprise court appearance Wednesday. He did not speak to the media. Spears, who lost custody of her two sons this week, was absent.

The couple had shared custody until Gordon’s ruling Monday gave custody to Federline.

Federline’s attorney indicated after the hearing that the court had modified its orders so that Spears could visit her sons while she tries to deal with what Gordon has described as her “habitual, frequent and continuous” use of drugs and alcohol.

The new court orders are expected to be released today.

“Kevin and his counsel felt the orders were justified and good for the children,” said Federline’s attorney, Mark Vincent Kaplan.

Kaplan said Federline was wearing a patch because he had a sore eye and the glare from the lights caused discomfort.

Spears was represented by lawyer Sorrell Trope, who left without speaking to reporters.
