Democratic Assemblyman Alton Waldon Jr. became the first black elected to Congress from Queens when a court Friday rejected an appeal by his challenger.

A three-judge panel of the U.S. 2nd Circuit Court of Appeals denied a request for an injunction by the Rev. Floyd Flake, who also is black, to prevent certifying Waldon as winner of the close election June 10 to fill the 6th District seat of the late Joseph P. Addabbo.
