The family lawyer for a teen-ager killed by her “preppie” date in Central Park turned over the victim’s heart-adorned diary today to a judge who will determine whether the suspect may use it in his defense.

Attorney Jeffrey Newman, accompanied by a police officer, said the family of Jennifer Levin, 18, “expects a prompt and fair determination” and said the diary contained “nothing relevant” to the case against Robert Chambers Jr., 20.

“It’s a pure fishing expedition,” he said.

Chambers admits killing the teen-ager he had dated several times over the summer but said he accidentally choked her during rough sex in Central Park.

The 6-foot-3, 185-pound college dropout claims Levin tied his hands behind his back with her panties and molested him.

In a brief court session this morning, the diary was given to state Supreme Court Justice Howard Bell in front of defense attorney Jack Litman and an associate.

The black spiral notebook-diary is about five-by-eight inches and has the white outline of a heart inscribed on the cover. Newman carried it in a manila envelope inside his attache case.

The diary chronicles from August, 1985, to about six weeks before Levin died Aug. 26. It contains two references to Chambers, allegedly before the teen-ager ever actually met the young man, the family says.

Bell said he expected it would take about 30 minutes to read the diary. But he said he did not expect to make a decision on whether to allow the defense to read the diary right away.
