Prop. 21
California has its infamous three-strikes law, and now proponents of Prop. 21 want voters to pass this initiative on March 7, to lower California’s standard for adult prosecution for juveniles from 16 to 14 years old, which moves the courtroom power from judges to prosecutors. Such draconian laws are better suited for noncapitalistic societies, where poverty does not ensure incarceration.
It is obvious our system is flawed. Prosecutors can’t seem to incarcerate the right person. Too many indigent inmates, like Herman Atkins, are rightfully being freed (Feb. 18). Only DNA saved his life. After 12 years in prison for rape, new evidence proves this 34-year-old man’s innocence.
My plea to California voters is to first find a perfect justice system, then apply perfect sentences. For justice does not count the strikes or the age in a society where wealth tips the scale.
