Re “The D.A.’s spotlight,” editorial, April 11
As the city attorney of Walnut, I’d like to urge a point of clarification.
The statement, “But the law prevents gatherings of a majority of an elected body without public notice and openness,” is not entirely correct.
The applicable statute does not allow “any congregation of a majority of the members of a legislative body at the same time and place to hear, discuss or deliberate upon any item that is within the subject matter jurisdiction of the legislative body or the local agency to which it pertains.”
The distinction allows members of the same elected body to lawfully attend functions that they would otherwise attend as individuals, such as parades, fairs, local sports events, funerals, grand openings and so on, as long as city business is not discussed.
