A state appeals court refused to award damages for lost wages to Bay Area Rapid Transit workers kept off their jobs for nearly three months after BART management virtually shut down the system in a 1979 labor dispute. The shutdown was justified, said a unanimous three-judge panel, because of a work slowdown, incidents of apparent sabotage and fears for the safety of passengers. The dispute arose when BART’s contract with two unions representing about 2,000 of its workers expired in June, 1979. Rather than continue operating without a contract, the system chose to cease operations from Aug. 31 until Nov. 23.
