A federal appeals court ordered a lower court to re-examine its 1986 ruling that an Ohio law regulating corporate takeovers is unconstitutional. Although the 6th Circuit Court upheld U.S. District Judge John Holschuh’s ruling later that year, the U.S. Supreme Court overturned it in 1987 and sent it back to the 6th Circuit for reconsideration. Lawyers representing Ohio contend that Holschuh’s decision still leaves in question whether the state’s takeover law is valid.
