Illegal alien workers are the province of the Immigration and Naturalization Service (INS), which has the power to levy fines in instances when illegals are found working. Once a Notice of Intent to Fine has been served, the company has 30 days to appeal. If there is no appeal, the fine goes into effect; if there is an appeal, it goes before an administrative law judge, who determines whether the fine is warranted. Known Hires are those workers an employer knows are not lawfully employable. If the INS comes back for a second audit and the employee is still not lawfully employable but remains on the payroll, the employer falls into the Continue to Employ category. Form I-9 is a non-discriminatory form required of all employees hired after 1986, which declares that the person has a legal right to work in the United States. If a company does not have the form on file for a particular individual, the employer is subject to fine or citation, regardless of whether the employee has the legal right to work.
