Malibu : $10,000 OKd for Appeal

The Malibu City Council voted unanimously Tuesday night to pay up to $10,000 to appeal the California Coastal Commission’s approval of Pepperdine University’s proposed expansion.

The council had been slated only to discuss the request for funding made by former Malibu Township Council member A. David Kogan, but strong sentiment prompted the immediate action.

The Malibu Township Council filed the suit against the Coastal Commission after the commission approved Pepperdine’s expansion plans in 1989. The council claimed in its suit that the Coastal Commission failed to conduct environmental impact studies and that the expansion would violate the Coastal Act, which limits development in the coastal zone. A judge dismissed the case last month.

Councilwoman Missy Zeitsoff said that since at least $10,000 has already been spent on the case, the council should follow through on it. Kogan’s request would go to pay the Environmental Defense Center, whose lawyers are handling the appeal.
