Judge in TV Rerun Case Asked to Step Aside: The Federal Communications Commission has asked a federal appeals judge to disqualify himself from the legal fight over whether the major broadcast networks should be allowed to sell lucrative TV reruns. Judge Richard Posner of the U.S. Court of Appeals for the 7th Circuit in Chicago was part of a three-judge panel that last month threw out the FCC’s 1991 decision that continued to block the networks from full participation in the syndication business. Both the FCC and Hollywood objected to Posner’s role in the case because he consulted CBS on a related issue several years ago. The request was made as part of filings by interested parties recommending that the 1991 “fin/syn” rules remain in effect while the case is on remand to the FCC.
