Judge Acquits Man of Carjacking College Pair
A federal judge in Providence acquitted one of the men accused in the carjacking slayings of two college students, saying prosecutors failed to prove it was a federal crime.
However, District Judge Ronald Lagueux said that he expects Kenneth Day, 23, to be indicted on state charges of robbery, kidnapping and murder.
“The government has failed to prove a case against this defendant of aiding and abetting the carjackers or conspiracy of carjacking,” Lagueux said.
Four of Day’s accomplices have pleaded guilty to federal charges and were spared the death penalty in the slayings of Amy Shute, 21, and Jason Burgeson, 20, in June 2000.
