Lindows-Microsoft Case Headed for Trial

Microsoft Corp.’s trademark infringement case against San Diego-based Lindows Inc. is heading to trial possibly this year after a federal appeals court denied a request to hear Microsoft’s appeal on a key matter in the legal battle.

The request centered on whether the word “windows” is a generic term in the technology industry or whether Redmond, Wash.-based Microsoft could argue that Lindows was violating its trademark by using a term similar to that of its Windows operating system.

Late last week the U.S. 9th Circuit Court of Appeals said it would not hear the appeal before the case went to trial.

Microsoft shares fell 13 cents to $25.76 on Nasdaq.
