In an unusual move, U.S. Supreme Court Justice Sandra Day O’Connor stepped into a child-support case, ordering an Orange County man to pay $225 a month to support his three children despite his claim that he cannot afford it. The state Court of Appeal had thrown out a lower court contempt finding against Phillip Feiock, wo had failed to make the payments ordered under a 1976 divorce decree. The California appellate court had ruled that it was unconstitutional to require the defendant to prove that he was unable to make the payments. O’Connor disagreed and stayed the state appeals court ruling.
