Local News in Brief : Newport Beach : City Pays $170,000 in Settling Shooting Case

The city has paid $170,000 to a man who was shot in 1985 by a police officer after the victim was chased from the roof of a See’s Candy Store and down several alleys.

The settlement, reached last month, ended a police brutality suit brought by the shooting victim, Brian Riley. Riley, who was then 17, climbed onto the roof of the candy store to look for a graduation party in the neighborhood, according to his attorney, Byron Rabin. His presence on the roof apparently frightened neighbors, who called the police.

When he saw police coming after him, Riley climbed back down and ran into an alleyway, Rabin said. Riley was shot once and lost part of his kidney. He has fully recovered, according to his attorney.

“The last he heard was, ‘Stop or I’ll shoot,’ ” Rabin said. “The next thing he knew was that he was shot.”

The city, however, claims Riley was shot in a scuffle with police.

“We are not conceding that there is anything wrong,” said Patrick Quinlivan the attorney for the city. “We are simply recognizing the risks of trial and resolving the case without going to trial.”
