GUATAY : Life Sentence Sought in Killings

Prosecutors brought charges of special circumstances Tuesday against a mother, her son and her boyfriend, accusing them of torturing two Guatay men before killing them.

Deputy Dist. Atty. Elizabeth Porterfield said she would seek a life sentence without parole if all three defendants are convicted in the 1990 deaths.

San Diego Superior Court Judge Herbert Exarhos scheduled a Nov. 2 trial date for Xenia King, 45, her son, Derek McGee, 22, and King’s boyfriend, Alan Mummert, 45.

The trio are accused of killing Dallas Underwood, 25, and Alan Ross, 31, whose bodies were discovered March 18, 1990, in a ravine near Alpine.

Ross was stabbed 16 times and struck with a blunt object. Underwood was stabbed five times after being hogtied and beaten.

Witnesses testified at the April 15 preliminary hearing that the victims were believed to have stolen property owned by the trio.

All three defendants lived in Guatay at the time, but they were not arrested and charged until January. King, Mummert and McGee all pleaded not guilty. They remain in jail in lieu of $1 million each.
