Cities to Ask Judge for Landfill Delay
The cities of Santa Paula and Fillmore will ask a judge next week to postpone the opening of an expanded Toland Road Landfill, officials said Monday.
The two cities want to delay the landfill’s planned Aug. 26 expansion when the dump is to become the main repository for west county trash. Oxnard’s Bailard Landfill is scheduled to close Aug. 24.
Santa Paula and Fillmore are seeking a preliminary injunction to keep the landfill from accepting up to 1,500 tons per day of trash until a lawsuit against the dump’s operator and the county can be heard, said Katherine Stone, an attorney representing the two cities. A hearing on their request is scheduled for Aug. 16 at the East County Courthouse in Simi Valley.
The cities oppose the expanded dump, saying the environmental impact report on the project was inadequate and there are serious concerns over seismic activity in the area.
A hearing on their lawsuit is scheduled Oct. 31.
