Prosecutors Seek to Join Kozlowski Charges

Prosecutors have asked a judge to combine all of the pending charges against L. Dennis Kozlowski, Tyco International Ltd.’s former chairman and chief executive, into a single case.

The Manhattan district attorney’s office is seeking to include outstanding sales-tax evasion charges against Kozlowski with charges that he and Mark Swartz, Tyco’s former chief financial officer, looted more than $600 million from the Bermuda-based conglomerate and its shareholders. They have denied wrongdoing.

New York state Supreme Court Justice Michael Obus is expected to rule by June 11 on motions by defense attorneys to dismiss the sales-tax charges and charges that Kozlowski used millions of dollars in Tyco funds to purchase artwork to furnish his New York apartment.
