MOORPARK : Dachshund Dispute Won’t Be Prosecuted

The president of the Moorpark school board, who has been at odds with her neighbors over the behavior of her miniature dachshund, won’t be prosecuted for allegedly violating a court order issued to keep the neighbors apart.

Moorpark Fire Capt. Richard Dobbin lives next door to board President Cynthia Hubbard and has been involved in a dispute with her for several months. He and his wife say Hubbard’s dog, Ginger, barks incessantly during the day. They filed for a restraining order against her after a confrontation in July over the dog’s behavior.

Last month, they say, Hubbard violated that order when she crossed into the Dobbins’ yard to retrieve her dog and allegedly struggled with Elizabeth Dobbin.

She will still be required to appear in court April 24 but will not be prosecuted due to “insufficient evidence to prove willful violation of the court order,” said Kevin J. McGee, assistant chief deputy attorney.

“I’m very happy,” Hubbard said of the district attorney’s decision. “The truth prevailed.”

The Dobbins could not be reached for comment.
