Ex-policeman to stand trial for alleged rape of stroke-impaired woman

A former Sacramento police officer was ordered to stand trial on charges that he raped a 75-year-old stroke-impaired woman in 2010.

Gary Dale Baker is scheduled to be arraigned Oct. 17 on two counts of rape, two counts of forced oral sex, two counts of sexual battery and one count of attempted sexual assault during a first-degree burglary, the Sacramento Bee reported.

Baker, 50, remains free on $1-million bail. The burglary-related offenses could bring Baker a life term in prison if convicted, the paper reported.

Authorities say the charges result from three incidents in which Baker contacted the woman at her residence starting in 2010.

According to an affidavit filed by the Sacramento County district attorney’s office, the woman first encountered Baker in the driveway of her apartment complex on Nov. 24, 2010, during which they had a brief exchange. She told authorities that he returned to her duplex later that day, forced his way inside, and raped her.

He allegedly returned on Sept. 20 last year. A surveillance camera that her family set up allegedly recorded Baker showing up at her house a final time on Dec. 18, 2012.

The alleged victim, who was not identified, was 75 and 77 years old at time of the interactions, according to prosecutors. She suffered a stroke prior to the alleged assaults in 2009 that left her with speech aphasia, a condition that severely restricts her ability to speak and write, the Bee reported.
