Racing! Let’s close the books on this one controversy

Hello, my name is John Cherwa and welcome back to our horse racing newsletter as we explore the recent controversy at Santa Anita.

A lot of you have emailed wondering what all the angst is over Sunday’s specially written race for small-stable trainers. Even a big-time East Coast sports editor dropped a note saying he was intrigued by this situation. So, I’ve talked to a few people on all sides of the issue in an effort to explain to you what went wrong and who’s to blame. Or, as this newsletter often says, “Who goofed, I’ve got to know?”

The background: Santa Anita boss Tim Ritvo asked that some races be written for trainers with 20 or fewer horses in their barn. To a person, everyone thinks this is a good idea. The sixth race on Sunday was the first of those races.

Here’s what it said in the program: “CLAIMING $10,000. PURSE $18,000. FOR FOUR YEAR OLDS AND UPWARD THIS RACE RESTRICTED TO TRAINERS WITH 20 OR LESS HORSES IN THEIR CARE IN CALIFORNIA. Weight, 123 Lbs Non-winners Of A Race Since November 10 Allowed 2 Lbs. Claiming Price $10,000 (Maiden And Claiming Races For $8,000 Or Less Not Considered). Six Furlongs.”

The race was won by Overcomer from the barn of Charles Treece. Jason Jocher, who owns Power Hour Racing and the second-place horse Airfoil, filed a protest with the California Horse Racing Board saying that Treece has more than 20 horses, most of them stabled at Los Alamitos.

The trainers: There are actually three trainers in question here. First, there is Treece, who has a handful stabled at Santa Anita but the rest, about 30, stabled at Los Alamitos.

Jesus Nunez, who saddled Dutt Bart who finished last, has around 40 thoroughbreds stabled at Los Alamitos and a handful at Santa Anita. The thing is that most of the Los Al horses would not meet the criteria to run any races at Santa Anita. Los Al runs cheap thoroughbred races at the beginning of their card.

And then there is David Jacobson, who ran Lewys Vaporizer. He has a handful of horses on the West Coast, but has a large East Coast stable. Last year, he made 469 starts nationally. The vast majority are on the East Coast. By comparison, Bob Baffert made 313 starts last year and Phi D’Amato made 510.

The racing office: Racing secretary Rick Hammerle, when asked by Jeremy Balan of Bloodhorse, said the condition was essentially a “guideline.” (here’s Jeremy’s story)

“We want to go down this list and say, ‘Does anybody stick out that looks like they don’t belong?’” Hammerle told Balan. “… It’s not a fine line, but if it doesn’t look right, we’re going to check it out.”

As to Nunez’s horses, Hammerle said: “[His] horses are running for $3,200 and $4,000 [claiming prices at Los Al]. I’m not counting those horses.”

The bottom line is this was discussed in the racing office in advance, at least when it came to Treece and Nunez. It would be a problem if no one noticed. As a former manager in sports departments, I rarely found fault with a decision if it was talked about first, even if I disagreed with the decision. Process is important.

Jury instructions: OK, ladies and gentlemen, you have the basic facts. It’s up to you to decide if these trainers tried to game the system, if the racing office bungled this, or if this has really been a waste of space and your time reading this.

The verdict: If I’m the judge, I put a few folks on probation, send them into room and if they come out with a solution, drop all charges. (The CHRB has a much bigger task in seeing if the public was harmed and who should get the purse money. Good luck.)

The real culprit here is a poorly written condition. Folks at the track tell me there was an understood parenthetical that the horses counted had to be eligible to run at Santa Anita. But that wasn’t what was written.

The biggest mistake was Hammerle saying that the condition is a “guideline.” Conditions aren’t conditions? They are just guesstimates? Does that mean a mile race may be 1 1/16 miles or 7 furlongs. No doubt, he regrets that quote.

Writing a condition is very difficult and the only thing more difficult is writing it for the first time. It would have been beneficial if the racing office had brought in some trainers or racing executives for a quick look and ask about loopholes. There’s a 50-50 chance they would have spotted something but who knows. But at least it would have been explored.

Then if there are loopholes after the race, say it’s a work in progress, and they will be fixed next time.

The issue with Jacobson is one to deal with when the intent is to incentivize small stables. But, the fact is that the conditions ony dealt with California so it seems fair to allow him to run. Is that really what Ritvo intended?

It’s a fact that trainers, like coaches, like businessmen, are always looking to game the system. I would like to think there were some trainers out there that could have ginned-up a case for eligibility but understanding what was intended decided to do the most honest thing. Of course, I also believe if I attach a horn to my dog’s head that he’s really a unicorn.

Bottom line, this isn’t a big deal if they rewrite the conditions for the next time. If they don’t, then some heads should roll. Enough said.

Santa Anita review

Thursday’s card could best be described as: Nothing to see here, move along. (Unless you took advantage of our free offer from Rob Henie’s West Coast Horse Racing report, which gave those who responded four winners and a cold exacta box in the last race.)

Friday is another one of those weekday cards flilled with claimers, five of the eight races. There are two allowance races, the second a 6-furlong contest for Cal-bred fillies and mares, 4 and up and the seventh, a 1 1/8 mile turf race, also for Cal-breds, 4 and up. Both races have a purse of $56,000.

There are three turf races, all with the rail at 30 feet to save the grass. One good thing to see if that four of the races have also eligibles, and two of those are dirt (5 ½ furlongs). It’s a sign of a robust horse population in which owners and trainers actually want to run.

FIRST RACE: No. 7 Candy Swirls (7-2)

Scheduled for one mile on turf, I like the chances of Candy Swirls in this $50,000 claimer restricted to 4-year-old fillies. Hailing from a top barn (Bill Spawr) and perhaps getting loose on the lead, 'Swirls can be tough to collar on the front end. Plus, she handles dirt if the race is taken off the grass.

Thursday result: Gracious Me finished second in the fifth race.

Los Alamitos weekend preview

I’ve decided to leave this weekly segment in the hands of Orlando Gutierrez, marketing and media maven at Los Al. So, take it away, Orlando.

“Los Alamitos starts with an eight-race card on Friday with a pick six carryover of $33,100. The total pool could reach more than $100,000, starting with the third race, which is set to have a full field of eight.

“The race will have She Can Too, owned and trained by Mike Harrington, as she makes her first start around the 870-yard Vessels course after making two starts over the Los Al one-mile course during the summer and winter daytime meets. Robert Bodenbender’s Sakab, who broke his maiden at this distance by 7 1/4 lengths on Nov. 4, is another top contender here.

“The eighth race is the final leg of the pick six and it has a nine-horse field running 300 yards. The $13,200 conditioned allowance for 3-year-olds will be headed by J. Francisco Diaz’s late blooming Checkn Seis, who won her racing debut on Oct. 13.

“On Sunday night is the $20,000 Barbara B Handicap, where He Is The Risingstar will look for a threepeat. Trained by Paul Jones, the 6-year-old gelding is perhaps the nation’s top 550-yard quarter horse. He’s won five stakes races at this rarely run distance since Dec. 2015. He’ll face a field that includes the thoroughbred sprinter Miss Loujean, a two-time winner at 870 yards at Los Alamitos since Nov. 17.

Ed Burgart LA play of the day

(My note: Ed was a perfect three for three last week. Rarely happens with any handicapper but no one knows QHs more than Ed.)

EIGHTH RACE: No. 9 Covington (4-1)

He should have been unsaddled in last nose loss for new connections when coming away in sluggish style while rallying to defeat Bargain Boy, who won for $16,000 last week. Gelding now moves to the far outside where he scored a 1 ¾-length maiden win four outs back. Connections give him positive class hike.

JOERAY had speed inside then saved ground stalking the pace, bid along the rail on the backstretch and second turn, battled inside in the stretch, took a short lead in deep stretch and gamely prevailed under left handed urging. STUDLY PERFECTION had speed outside the winner then inched away and set the pace a bit off the rail, dueled outside that one on the backstretch and second turn, fought back through the stretch and continued willingly to the end. JUMP THE TRACKS bobbled at the start, went four wide into the first turn, stalked three deep then off the rail on the second turn and three wide into the stretch and bested the others. CULPABLE chased a bit off the rail then inside, came out on the second turn and four wide into the stretch and lacked a rally. CASH PILOT between horses early, stalked the pace inside, continued along the rail in the stretch and weakened. ETERNAL ENDEAVOUR (GB) bobbled at the start, saved ground stalking the pace, came out on the second turn, bid four wide into the stretch to gain the lead and drew clear while drifting in under urging. TELL ME MORE stalked a bit off the rail then bid between horses to duel for the lead, was carried three deep into the stretch, also drifted in and was clearly second best. STURDY ONE stalked three deep between horses, bid three wide leaving the turn, took the lead into the stretch, inched away under urging a sixteenth out and won clear. BE A LADY bobbled some at the start, went between horses then dueled outside a rival, battled between horses leaving the turn, fought back inside the winner in the stretch, could not match that one late and held second. REVENUE VIRGINIUS a step slow to begin, stalked inside, came out into the stretch and gained the show late. TEE EM EYE stalked four wide then outside on the turn, bid four wide into the stretch and lost third late. MS DUPREE had good early speed and dueled a bit off the rail then inside, inched away leaving the turn, came out a bit into the stretch and proved best under urging. GRACIOUS ME angled in and dueled outside the winner, stalked leaving the turn and into the stretch and just held second. WICKED STORM close up stalking the pace inside throughout, just missed the place. D D'S LUTE well placed stalking the pace outside then three deep on the turn and into the stretch, lacked the necessary response. MISCHIEVOUS SONG stalked between horses on the backstretch and turn, continued outside a rival into the stretch and weakened. PACIFIC KITTY a bit slow to begin, saved ground off the pace, cut the corner into the stretch and improved position. THE NINE O chased between horses then off the rail into and on the turn, came three wide into the stretch and did not rally. FLAMMETTA settled between rivals then off the rail, also came three wide into the stretch and lacked a rally. SWALLOWS INN GAL chased between horses then a bit off the rail, continued outside a rival on the turn, dropped back between foes leaving the turn and weakened. MISS GEORGIE GAL settled outside, chased three deep on the turn and four wide into the stretch and did not rally. AN EDDIE SURPRISE saved ground chasing the pace, came a bit off the rail on the turn and into the stretch and weakened.
