In spite of what many people think, just because a woman cries rape does not make it so to a criminal certainty. For those who think otherwise, go back and re-read this article again ... slowly. Good job by the SVPD!

What gives?
Today's story just compounds the situation and goes way beyond the reasonable doubt standard and the perponderance of evidence, by the defense, would lead into 530.6 Cal PC motion and certification, by the court.
The problem is the belief that by prosecuting the alleged complaintant, is that there will be a feeling of potential prosectors of victims, should thier reports fail to pan-out.
If I was the DA, I'f seek an indictment from the Grand Jury and let the chips fall where they may.

A good friend went through something very similar to this, was arrested several timea and actually went to trial, where he was acquited. The judge in his case was furious that a case with no evidence went that far. A year later he discovered that his wife had been having an affair with a neighbor and they schemed to take his business, house and all his assets. My friend is now a shell of what he was, paranoid, depressed, business gone, a totally broken man. His wife, like West got off scott free.
This is an outrage. West should have been tried and sent away for years. There should be a database form the public, similar to the sex offender database, for criminals like West.
