The Texas Board of Pardons and Paroles is expected to rule Tuesday on a request to commute Jesse De La Rosa’s execution Wednesday for a murder during a store robbery that netted a six-pack of beer.

Ronald Guyer, De La Rosa’s attorney, said he has also requested a hearing before the U.S. 5th Circuit Court of Appeals in New Orleans.
