Frozfruit Corp. filed a suit against Shamitoff Foods.

The Gardena-based makers of gourmet frozen fruit bars filed suit against Shamitoff Foods of Redwood City, Calif., for trademark infringement. The lawsuit, filed in U.S. District Court in Los Angeles, charges Shamitoff with selling a frozen fruit bar using a similar name, similar transparent plastic wrapper and similar label to those of Frozfruit. Shamitoff, a subsidiary of Frozen Confections, is selling its fruit bar in a new wrapper that is labeled “Frozen Fruit.” The suit seeks a permanent injunction to prohibit Shamitoff from using the name “Frozen Fruit” or any product name similar to “Frozfruit.”
