The developers of a hotel, restaurant and office complex proposed for two parking lots flanking the County Administration Center missed their deadline Friday for paying $25,000 they owe the county to secure the right to build on the land.

Harbor Square Associates had said previously that they would not make the lease payment, which was first due in March. The Board of Supervisors declared the partnership in default May 7 and now has the right to terminate its contract with the developer without notice, said Richard Robinson, the county’s director of special projects.

The partners say they should not have to make the monthly payments because the City of San Diego, which has land-use control over the project, has not explained what the developers could do to win city approval. The City Council rejected the latest plans for Harbor Square March 26.

The Board of Supervisors is scheduled to decide Tuesday whether to terminate the contract with Harbor Square Associates and search for another developer to build on the site.
