Rejecting arguments that a raid on Santa Anita Racetrack violated constitutional protection against unreasonable searches and seizures, Los Angeles federal Judge Laughlin E. Waters denied a request for a temporary restraining order naming the U.S. Immigration and Naturalization Service. The order, sought by the Oak Tree Racing Assn., was requested following a raid on the Arcadia racetrack last Wednesday by federal agents, who detained 169 illegal aliens. Attorney Bill Bottger, representing the association, argued that the search warrant authorizing the raid did not name those to be arrested, which he maintained is required by the Fourth Amendment to the U.S. Constitution. Assistant U.S. Atty. Ian Fan maintained that the warrant was legal and that an affidavit filed under seal with the court provides “ample probable cause” for the INS action.
