Council Rejects Developer’s Claim Over Apartment Zoning

The Glendale City Council this week rejected a claim for $9.1 million in damages filed by a developer who was denied permission to build a 104-unit apartment complex on Alpha Road in Verdugo Canyon.

The council’s action is a routine procedure required before developer Marc Kogan can file a court action against the city.

Residents near the site of the proposed development at 1905-07 Alpha Road had unanimously opposed the project, saying the neighborhood is overcrowded and has traffic problems.

Kogan proposed to build the apartments on land zoned for high-density development but the City Council in August voted to lower the permitted density on the property and nearby parcels to that of single-family homes, permitting a maximum of 16 homes on the vacant four-acre site.
