A so-called yuppie tax that placed a 2% levy on health club membership fees has been adjudged unconstitutional.

Cook County Circuit Judge George Higgins said Monday that the city ordinance, approved by the City Council in December and expected to raise $900,000 a year, placed the burden of collecting the tax on the clubs.

The law was “vague and uncertain” and amounted to an illegal tax on an occupation, Higgins ruled.
