The U.S. 9th Circuit Court of Appeals in San Francisco ruled that parents with conflicting child custody decisions in two states cannot use the Parental Kidnaping Prevention Act of 1980 to resolve the issues in federal court. The decision affirms a lower court’s dismissal of a lawsuit by David A. Thompson, who went to federal court seeking to regain the right to visit his son, Matthew, granted under a California order but limited under a decision by courts in Louisiana. It conflicts, however, with decisions in three other appeals courts in other parts of the country, which means that the final decision may rest with the U.S. Supreme Court.
