The state of Montana cannot impose taxes on coal extracted from land belonging to the Crow Indian tribe, the U.S. 9th Circuit Court of Appeals ruled in San Francisco. The court, reversing U.S. District Judge James F. Battin, said the coal taxes are preempted by federal law and policies and interfere with tribal autonomy. Taxing Indian income derived from activities conducted on reservation property is prohibited without congressional consent, the court said.
