Despite an appellate court ruling to the contrary, the director of the state Employment Development Department said the agency will continue to verify the legal U.S. residence status of job applicants before referring them to prospective employers. The 1st District Court of Appeal in San Francisco made the ruling on a lawsuit filed by several minority groups, which argued that the practice was discriminatory. Employment Development Director Kaye Kiddoo reported filing emergency regulations with the Office of Administrative Law that will allow continuation of the practice pending the outcome of further legal action. The new federal Immigration Reform and Control Act requires that employees be legal residents of the United States and puts the burden on employers to provide proof.
