Local News in Brief : MCA Suit Dismissed

A lawsuit filed by MCA against the city of Burbank to block a retail-entertainment complex proposed by entertainment rival Walt Disney Co. was dismissed by a Los Angeles Superior Court judge.

In granting the city’s motion to dismiss the suit, Judge Warren H. Deering also ordered MCA to pay Burbank’s court costs.

MCA filed two lawsuits last year in an attempt to end Burbank’s tentative agreement with Disney for the development of “The Disney-MGM Studio Backlot” on a city redevelopment parcel.

The suit dismissed Wednesday alleged that the city failed to adequately determine the environmental impact of the project. In addition, MCA attorney Gregory Stone called the deal a “waste of taxpayers’ funds” because Burbank agreed to sell Disney 40 acres for $1 million, which he said was far below fair market value.

In the second lawsuit, which is still pending, MCA alleges that the city violated state privacy laws by meeting privately with Disney representatives and secretly agreeing to the deal before voting unanimously May 5 to give Disney an option on the parcel.
