A judge failed in an attempt to settle the 2-year-old legal dispute between wine makers Ernest and Julio Gallo and their younger brother over his use of the family name on his Joseph Gallo brand of cheese. Joseph Gallo has countered by seeking a share in the Modesto winery, the world’s largest, which he maintains was begun by commingling family assets after the deaths of the Gallos’ parents when Joseph, 68, was still a minor. Ernest Gallo is 79 and Julio is 78. Unless a settlement is achieved, the case is scheduled for this November in Fresno.
