A federal judge threw out a challenge by Carl C. Icahn to the reorganization plan that allowed Texaco to emerge from bankruptcy earlier this year. U.S. District Judge Gerard L. Goettel in White Plains, N.Y., said the case was moot because Icahn had failed to seek a stay of enforcement of the plan when it was approved. Icahn challenged two aspects of the reorganization, claiming that its provisions were unnecessary and contrary to the best interests of the shareholders. He also charged that they were included as a result of “self dealing” of Texaco officers and directors.
