Justice Temporarily Halts Trial of GAF
U.S. Supreme Court Justice Thurgood Marshall issued an order Sunday night temporarily halting the second trial of the GAF Corp. pending further proceedings, the company said.
Marshall issued the stay to allow defense attorneys for GAF to prepare arguments that the second trial amounted to double jeopardy, which is forbidden by the Constitution.
Marshall gave government prosecutors until 11 a.m. EST Wednesday to respond.
On Jan. 10, federal judge Mary Johnson Lowe declared a mistrial, ending GAF’s first trial. The mistrial was declared after prosecutors failed to disclose that they had an expert’s report that a key document had been altered.
GAF Corp. is accused of conspiring with Los Angeles broker Boyd Jefferies to manipulate the stock of the Union Carbide Corp.
