The U.S. 10th Circuit Court of Appeals in Denver has withdrawn its June 2 decision that revived the Brown vs. Topeka Board of Education desegregation case, a court official said. Attorneys said they were unsure what the action means for the Topeka, Kan., school system. In June, the appeals court overturned a 1987 ruling by a U.S. district court judge that said there was no illegal separation of races in the school system. The appeals court said the Topeka school system had not done enough to overcome remnants of the segregation that existed before the U.S. Supreme Court decided in the 1954 Brown vs. Topeka Board of Education case that the “separate but equal” concept for public schools was unconstitutional.
