No Charge on Officer Who Killed Wife

A Chula Vista police officer who said he was acting in self-defense when he shot and killed his wife will not be prosecuted for his actions in the July 10 incident, the district attorney’s office said Thursday.

John McAvenia, 27, told prosecutors he fired a shot after his wife Diane McAvenia, 26, attacked him with a knife during a domestic dispute at the couple’s South San Diego home. McAvenia then called 911 and reported the shooting.

On Thursday, deputy district attorney Daniel Lamborn said his office lacked sufficient evidence to disprove the patrolman’s account of the events.

If McAvenia is cleared by a police psychologist and the department’s review board, as expected, he could return to active duty within 10 days, said Chula Vista Police Chief Bill Winters.
